recording of a traffic ticket trial held in the Hiram Municipal
Court on Monday August 21st, 2006. This audio is approximately 28 minutes long and is very representative
of what one will encounter in most
Georgia traffic
courts whether or not your alleged violation is the same as the one
being tried. This gives you a good idea what to expect in a typical
Georgia traffic court trial.

NOTE: In the 100’s
of Georgia
courts I have personally visited, and of the 1000’s of trials I have
listened to and observed, the Judge of the Hiram Municipal Court,
the Honorable Judge Martin Valbuena is without a doubt the fairest
judge I have ever witnessed. Do not make the mistake of confusing
that with soft, for he is not. If a person is guilty, and the
state proves their case, they will be found so. But on the occasions
I have watched trials in Judge Valbuena’s court, he has always
seemed very fair.

Valbuena is a rare exception and as such, this is the only page on
our website we do not spell court with a K.

Synopsis
The “State of
Georgia
versus Kevin Thompson”
where the defendant was accused of allegedly violating the official
instructions of a STOP
sign. As you will see, at no time does Trial by Ambush
ever require you to testify on your behalf, or even discuss
your driving behavior. At no time did the defendant ever discuss his
driving or whether or not he even ran the stop sign.
Instead, the
defendant in this case applied proper legal strategies
against the states evidence and was found NOT GUILTY.
The below picture is a scanned image of the exact same
non-digital photo that was presented as evidence in the trial
referenced to on this page. As you can clearly see, this photo made
prior to August 21st shows 2 REGULATORY signs mounted to
the same post. Regulatory signs are signs that give MANDATORY
instructions and therefore must be placed 1 per post per the MUTCD
and Georgia DOT regulations referenced in this audio case.

The below picture I made with my digital camera on Friday
August 25th. In this photo I tried to replicate the photo
above made prior to Monday August 21st. In this photo you
can clearly see it didn’t take the City of
Hiram
long (less than 4 days) to bring this official traffic control
device into compliance following the Kevin Thompson trial.

Commentary
When listening to the audio recording, pay special attention
to the recording at the following times.
23:30
when the officer states “I would agree
with him on that part”
25:53 when the officer states “I do say that the
25 MPH speed limit sign should not have been on there. At the time I
wrote this citation I will be honest I was not familiar with that
sign being on that stop sign. You can’t see that part from where I
was sitting.
You will also hear the officer testify that a STOP sign must
be 8 feet high. This is wrong. A stop sign must be 5 feet high if
there is no pedestrian traffic in the area, and 7 feet high if
pedestrian traffic exists. These are FEDERAL laws that the state of
Georgia is
bound to follow. Clearly this officer did not have a clue as to how
high a STOP sign must be in order to be legally enforced. Most
officers do not.
Of a special note, during the trial while Mr. Thompson is
cross examining Officer Oates, the City of Hiram Police Chief
sitting up on the bench next to the judge interrupts during the
trial and asks the judge if he may speak to Office Oates for a
minute. That is clearly wrong, and grounds for a mistrial had the
judge allowed it. Fortunately the judge did not. Completely
unbelievable this Police Chief asked this of this judge. This
unbelievable outburst can be heard at the following time on the
recording.
